ELIGIBILITY
You must be 18 years or older to purchase a raffle entry. Only one individual may be identified as the purchaser or buyer of the raffle entry. Entries may be purchased in person, by telephone (212 833-5444 during regular business hours EDT) or via the internet. Ticket confirmation numbers will be emailed to internet purchasers upon order completion. All communications including raffle ticket confirmation will be sent to the email address supplied during purchase. It is the purchaser's responsibility to provide a valid, deliverable email address in order to receive raffle ticket confirmation, and to remove spam or system blocks which may prevent confirmation delivery. TJ Martell Foundation and its agents, vendors, and staff assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received and these entries will be deemed invalid and shall be immediately disqualified. TJ Martell Foundation employees and their families are not eligible to participate in the raffle.

DRAWING
There is a maximum of 500 entries sold for this raffle. Each ticket will be entered separately in the drawing. Each ticket is a separate and equal chance to win. Drawing will take place on September 29, 2007. All tickets must be received by the drawing date to be eligible for the drawing.

NOTIFICATION OF WINNERS
All winners will be notified via email of the prize won and any requisite procedure to claim the prize. Winners of the prize shall have twenty (20) calendar days to pick up the car from Lexus of Riverside, 3150 Adams Blvd., Riverside, CA. Winners name will be posted at the T.J. Martell Foundation website. If a selected winner is unable to be contacted or located after a period of seven (7) days from the draw date the raffle, another drawing will be held. All contact attempts shall be made to the address and email provided by the raffle entry purchaser. Due to postal regulations, raffle ticket stubs cannot be returned by mail for purchases over the Internet, through the mail or by telephone. When an order is placed, we will complete the ticket by filling in the name, address, and phone number, and we will drop the ticket in the barrel. At the drawing, the winner will be contacted based on the name and information on the ticket. Purchasers do not need their ticket stubs for any reason. However, the stubs will be kept on file at the T.J. Martell Foundation. Purchasers can call the T.J. Martell Foundation or email to check when the order was processed and obtain their ticket number if so desired. All winners, by entering, authorize the TJ Martell Foundation to publish their name and likeness along with their prize on the website and for it to be used in other promotional materials.

WAIVER/LIMITATIONS OF LIABILITY
Entry purchasers, by participating (and winners, by accepting a prize) release TJ Martell Foundation, and its respective staff, board members, vendors, agents, representatives, sponsors, and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, from any and all liability with respect to participation in the promotion and possession or use of the prize awarded.. Any liability of the TJ Martell Foundation shall be limited to ticket price paid and in the case of any dispute, TJ Martell Foundation's decision shall be final. Winner is solely responsible for all taxes, expenses and transportation not included as part of this raffle. Winner agrees to the use of his/her name, address, photograph or videotape likeness and statements for publicity purposes by the T.J. Martell Foundation.

IMPORTANT: If, for whatever reason, less than 275 tickets are sold by the draw date of September 29, 2007, no drawing will be held and all ticket purchases will be reimbursed for the price ($100.00) of their ticket. The decision not to hold a drawing based upon insufficient ticket sales will be final.
